BRITISH CITIZENSHIP BY AUTOMATIC ACQUISITION FOR SWISS CITIZENS (AND NON-SWISS CITIZENS)


Under British nationality law, some Swiss citizens (and non-Swiss citizens) residing in Switzerland may automatically acquire British citizenship without needing to submit an application. If you possess British citizenship by Automatic Acquisition, you have the right to enter and reside in the United Kingdom without immigration restrictions.


Requirements for Swiss Citizens (and non-Swiss Citizens) to Acquire British Citizenship by Automatic Acquisition


As a Swiss national (or non-Swiss national), to qualify for British Citizenship by Automatic Acquisition, you must demonstrate that you acquired British citizenship by operation of law. The most common scenarios include:


  1. Born in the UK on or after 1 January 1983:

    • Your mother or father was a British citizen or settled in the UK at the time of your birth.


  2. Born outside the UK on or after 1 January 1983:

    • Your mother or father was a British citizen otherwise than by descent at the time of your birth.


  3. Born before 1 January 1983:

    • You were a Citizen of the UK and Colonies with the right of abode in the United Kingdom immediately before that date.

  • You were found abandoned as an infant in the UK on or after 1 January 1983.

  • You were born in the UK on or after 13 January 2010, and your parent was a member of the armed forces.

  • You were born outside the UK on or after 1 January 1983, and your mother or father was a British citizen serving outside the UK under qualifying service.

  • You were adopted outside the UK under a Convention adoption on or after 1 January 1983, and one of your adoptive parents was a British citizen, with both adopters habitually resident in the UK at the time of adoption.

  • You were born, adopted, naturalised, or registered as a Citizen of the UK and Colonies before 1 January 1983, with specific conditions met regarding your parents or adoptive parents' citizenship status.

  • You were a Commonwealth citizen immediately before 1 January 1983, and your mother or father (or adoptive parent) was a Citizen of the UK and Colonies by birth in the UK at the time of your birth or adoption.


The definition of 'father' under British nationality law has varied, so it's crucial to verify your specific circumstances. Similarly, British citizenship by descent is defined under British nationality law, necessitating confirmation of how your parents acquired their British citizenship if you were born outside the UK.


The UK includes the Channel Islands, the Isle of Man, and specific qualifying territories from designated dates.
